These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you”, “the customer”) and Vivante Imports (“we”, “us”, “our”), operator of this website. By browsing our site, creating an account, or placing an order, you confirm that you have read, understood, and agreed to be bound by these Terms.

These Terms apply alongside our Privacy Policy, Shipping Policy, and Return & Refund Policy. In the event of a conflict, the terms displayed at the point of purchase prevail for that specific transaction.

Who Can Buy From Us

You must be at least 18 years old (or have the consent of a parent or legal guardian) and capable of entering a binding contract under Nigerian law to place an order. By ordering, you confirm that you meet this requirement.

Your Account

You are responsible for keeping your login credentials confidential. Any activity carried out from your account is treated as carried out by you. Notify us immediately at info@vivanteimports.com if you suspect unauthorised use of your account.

You agree to provide accurate, current, and complete information when registering or placing an order, and to keep that information up to date at all times.

You may use the website for personal, lawful shopping only. You agree not to:

• Breach any applicable law or regulation of Nigeria or any other jurisdiction
• Submit malware, scripts, scrapers, or anything that could damage or interfere with the website
• Attempt unauthorised access to our systems, other users’ accounts, or infrastructure
• Use the website to commit fraud, chargebacks abuse, money laundering, or any criminal activity
• Impersonate another person or misrepresent your identity, age, or affiliation
• Resell our products in a way that misleads customers about origin, authenticity, or pricing

We may suspend or permanently close any account that breaches this section and may report suspected criminal activity to appropriate authorities.

Product Information

We work hard to describe our products accurately, including images, sizes, materials, and features. Slight variations in colour, dimension, or finish may occur as items are sourced directly from manufacturers and device screens render colours differently. These minor variations are not defects.

Prices

All prices on the website are displayed in Nigerian Naira (₦). We may change prices, run promotions, set quantity limits, or discontinue a product at any time. Discount codes have their own terms displayed when issued.

Stock & Availability

Listing a product on the website is an invitation to treat, not a guarantee of availability. If a product becomes unavailable after your order is placed, we will contact you to offer a replacement, a back-order timeline, or a full refund.

How an Order is Formed

When you submit an order through checkout, you are making an offer to purchase the listed products at the listed price. A binding contract is formed only when we send you an order confirmation via email or SMS.

We may decline or cancel an order where the product is unavailable or wrongly priced, where we suspect fraud or unauthorised payment, or where your delivery address is outside our serviceable area.

Payment Methods

We accept major debit and credit cards, bank transfers, and other payment methods as displayed at checkout. Payment details are processed securely and never stored on our servers.

Cancelling an Order

You may request a cancellation by contacting us at info@vivanteimports.com or +234 808 425 1688. We can accommodate cancellations only before the order is dispatched. Once an order has been packaged or handed to a courier, cancellations may be treated as a return.

We deliver across Nigeria. Delivery options, timelines, and serviceable zones are set out in our Shipping Policy, which forms part of these Terms.

You are responsible for providing an accurate and complete delivery address, a reachable phone number, and ensuring someone is available to receive the order. Failed deliveries due to wrong addresses, unreachable contacts, or refused acceptance may attract a re-delivery fee.

Risk of loss or damage passes to you upon successful delivery. For store pickup, risk passes upon collection. We recommend inspecting your package upon receipt and reporting any visible damage immediately.

We want you to be completely satisfied with your purchase. You may request a return or exchange within 24 hours of delivery, subject to the criteria below.

Eligible for Return

• Item is unused, in original condition, and in its original packaging with all tags attached
• You have proof of purchase (order number, email confirmation, or receipt)
• The item is faulty, damaged on arrival, or significantly different from what was advertised

Not Eligible for Return

• Used, washed, worn, or altered items
• Intimate apparel, undergarments, swimwear, or earrings once packaging is broken
• Cosmetics and personal-care items that have been opened or used
• Items marked “Final Sale” or sold at heavily discounted bundle prices
• Items damaged by the customer after delivery

Refunds

Once we receive and inspect the returned item, we will issue your refund to the original payment method within 5–7 business days. Where the return is due to our error (faulty, wrong, or damaged item), we will cover return shipping costs.

We warrant that products sold on our platform are of merchantable quality and fit for ordinary use. Where a manufacturer’s warranty applies (for example, electronics), the manufacturer’s terms govern that warranty period in addition to our 24-hour returns window.

Outside the 24-hour window, we will assist you in making any claim under the applicable manufacturer’s warranty, but we are not the warrantor for that extended period.

All content on this website — including the Vivante Imports name, logo, graphics, photographs, product descriptions, page layouts, and overall look and feel — is owned by Vivante Imports or our licensors and is protected by applicable intellectual property laws.

You may view, download, and print pages for your personal, non-commercial use only. You must not copy, redistribute, scrape, republish, or create derivative works from any content without our prior written permission.

By placing an order, you agree to receive operational messages from us via email, SMS, and WhatsApp, including order confirmations, payment updates, and delivery notifications. These messages are essential to fulfilling your order.

Marketing messages (promotions, new arrivals, special deals) are sent only with your consent. You may opt out at any time by contacting us at info@vivanteimports.com.

To the fullest extent permitted by law, Vivante Imports shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the website or any product purchased through it.

Our total liability for any claim arising out of an order will not exceed the total amount you paid for the affected order. Nothing in these Terms excludes liability that cannot lawfully be excluded under Nigerian law.

These Terms, and any dispute arising out of them or your use of the website, are governed by the laws of the Federal Republic of Nigeria. Before starting any legal action, you agree to first contact us to try to resolve the matter in good faith within 30 days.

If we cannot resolve the dispute within that period, the courts of the Federal Republic of Nigeria shall have exclusive jurisdiction.
